2. This order shall be applicable if the manufacturer of the formulation specified in column (2) of the Table above has complied with the requirements, if any, of
(a) the Drugs and Cosmetics Act, 1940 (23 of 1940) and the rules made thereunder; and
(b) the Industries (Development and Regulation) Act, 1951 (65 of 1951) as amended from time to time.
3. These prices/revised prices shall be made effective within 15 days of receipt of this order as required under sub para 14(1) of DPCO, 1995. The necessary price-list should also be issued as required under sub-paragraph (3) of paragraph 14 of the Drugs (Prices Control) Order, 1995.
4. The prices given in Column 7 of the above table will remain valid subject to the conditions that the company purchases the bulk drug exclusively from indigenous manufacturer(s) and the company submits the return every month to the Government/NPPA regarding procurement (quantity and price) of the bulk drug and sale (quantity and price) of the formulation(s).
